CCRules for using Culture Column
These Terms form an agreement between you and NYK Holdings, doing business as Culture Column, governing access to culturecolumn.com and related publication services. If you do not agree, do not use the services.
Using the site signifies acceptance of the Terms then posted.
You must be legally capable of agreeing to these Terms. If you use Culture Column for an organization, you represent that you have authority to bind that organization, and you and the organization are responsible for compliance.
We may revise these Terms prospectively. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law. Separate written terms may govern advertising, licensing, events, or other services; those terms control if they conflict with these Terms.
Culture Column does not provide individualized professional advice or guaranteed outcomes.
Content is provided for general informational and editorial purposes. It is not medical, legal, financial, investment, tax, engineering, cybersecurity, or other professional advice and does not create a professional-client, fiduciary, confidential, or advisory relationship.
You are responsible for checking current laws, recalls, warnings, instructions, compatibility, contracts, prices, availability, and suitability for your circumstances and for consulting a qualified professional when appropriate. Do not delay emergency help or professional care because of content on the site.
The services are provided as available and may contain errors, delays, or omissions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTURE COLUMN, NYK HOLDINGS, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that content is current, error-free, uninterrupted, secure, suitable for a particular use, or that a product, service, practice, link, recommendation, or third party will perform as described. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
Liability is limited to the fullest extent the law allows.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CULTURE COLUMN PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; PERSONAL DECISIONS OR PURCHASES; OR DAMAGES ARISING FROM RELIANCE, INTERRUPTION, SECURITY EVENTS, THIRD PARTIES, OR UNAVAILABILITY, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE CULTURE COLUMN PARTIES FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS OR THE AMOUNT YOU PAID NYK HOLDINGS FOR THE RELEVANT SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not exclude liability that cannot lawfully be excluded or limited. Applicable consumer rights remain available.
Personal reading and ordinary linking are welcome; republication and extraction are restricted.
The site, selection, arrangement, writing, graphics, photography, branding, code, and other original material are owned by or licensed to NYK Holdings and protected by applicable law. Culture Column names, marks, and visual identity may not be used to imply affiliation or endorsement without written permission.
You may access the site for personal, non-commercial use, quote limited portions with clear attribution and a link, and share ordinary links. Unless law permits or NYK Holdings agrees in writing, you may not reproduce substantial content, republish articles, sell access, remove notices, frame the site, create confusingly similar material, build a competing dataset, or use automated means to scrape, harvest, train on, or extract content at scale.
Do not send material you lack the right to share or expect to remain confidential.
Except where Culture Column expressly agrees otherwise in writing, pitches, feedback, correction requests, ideas, and other unsolicited submissions are non-confidential. You retain ownership of your original material but grant NYK Holdings a worldwide, non-exclusive, royalty-free license to receive, store, reproduce, adapt, quote, and use it as reasonably necessary to review, respond, report, verify, defend, or improve the publication.
You represent that your submission is accurate to the best of your knowledge, lawful, and does not violate another person's rights. Do not submit trade secrets, privileged communications, malware, unlawful material, or sensitive records not necessary to the request. Submission does not create an obligation to publish, compensate, respond, return material, or maintain confidentiality.
Do not interfere with the site, its readers, or its rights.
You may not violate law; infringe rights; impersonate others; bypass access or security controls; probe or disrupt systems; introduce malicious code; overload infrastructure; harvest contact information; send spam; manipulate analytics; use the site to threaten or harass; or assist another person in doing so.
We may block, limit, investigate, preserve evidence of, or report suspected abuse without notice. We are not obligated to monitor every use or enforce these Terms for another person's benefit.
External parties remain responsible for their products, terms, and conduct.
Links, advertisements, affiliate relationships, mentions, and integrations may lead to third-party services. Culture Column does not control and is not responsible for third-party content, availability, security, privacy, pricing, contracts, fulfillment, returns, warranties, or conduct.
A review, selection, link, or advertisement is not a warranty, certification, or assumption of seller responsibility. Any transaction is between you and the relevant third party unless a separate written agreement with NYK Holdings expressly states otherwise.
Organizations and commercial users are responsible for harm caused by their misuse or submissions.
To the extent permitted by law, if you use the services on behalf of an organization or for commercial purposes, you will defend, indemnify, and hold harmless the Culture Column parties from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use, your submitted material, your breach of these Terms, or your infringement of another person's rights.
This section does not require a consumer to indemnify a party for that party's own unlawful conduct where prohibited by applicable law.
The publication may change, suspend, or discontinue services without guaranteeing permanence.
We may modify, restrict, suspend, or discontinue any feature, article, service, or access at any time, subject to applicable law and any separate written agreement. We are not responsible for preserving links, archives, search ranking, or third-party copies.
These Terms and incorporated policies are the entire agreement for general site use. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue. Failure to enforce is not a waiver. You may not assign your rights without written consent; NYK Holdings may assign these Terms in connection with its operations or a transaction.
Applicable law and forum will be determined under mandatory law and the jurisdiction connected to NYK Holdings' principal place of business, without giving effect to conflict-of-law rules, unless a separate written agreement states otherwise. Before filing a non-urgent dispute, contact legal@culturecolumn.com with enough detail to permit good-faith review.
